Employee's Ultimatum to Quit Treated as Resignation

In Kerr v. 2463103 Nova Scotia Ltd. the Nova Scotia Supreme Court found that the plaintiff, Kerr, did indeed resign when he offered his employer an ultimatum of either receiving a pay increase or he would leave for another job offer. The employer indicated that if his job performance improved he would receive a pay increase. The employer waited 3 weeks. During that time Mr. Kerr did not retract his ultimatum, nor did he make any changes to improve his performance. After 3 weeks, the employer accepted his resignation and Mr. Kerr brought forward a motion of wrongful dismissal.

A reasonable person would have understood that Kerr was serious in his intention to resign and take up another job opportunity that would pay more if he was not given the demanded raise. We attended the Canadian HR Mining Leadership Conference on April 24th at York University. Key topics covered included Workforce Planning, Mergers & Acquisitions, Employment Law Trends, Workplace Investigations and Trends in Employee Benefit Programs.
