Be Aware of Potential Discrimination of Interview Candidates

Desjardins was fined $4K for discriminating against a candidate on the basis of creed in Widdis v. Desjardins Group . Widdis was asked in a phone screen interview if she could work Saturdays as the call centre contract position required working rotational Saturdays. She indicated that as she was a 7th Day Adventist she could not work Saturdays.

"An employer can ask in a job interview about availability to work because it can refuse to hire someone who can’t work certain days, if the requirement to work those days is bona fide and reasonable, and there’s no way to accommodate the person’s religion. The key issue is whether the employer exhausts all possibilities for accommodation before refusing the applicant based on the inability to work that day in question."

After a wonderful holiday break of spending time with friends and family, we are off to the races with a busy 2014! On the agenda, attending HRPA's annual conference at the end of January in Toronto, conducting various training sessions in the US and Canada, continuing to work with our clients on their recruiting, compensation, workplace policies, employee relations, HR compliance and training needs.
