From the Just Cause Terminations webinar put on by HRPA yesterday "Termination is the Capital Punishment of employment law"; the highest disciplinary measure available to employers and therefore there is a high burden of proof on the part of the employer to prove just cause. Common mistakes employers make in trying to assert just cause include:
- verbal warnings only
- poor progressive discipline (inconsistency, unreasonable expectations, unreasonable timelines, no warning of further discipline)
- lack of consistency with other workers
- tolerance/condonation of the behaviour
- jumping to cause
- not asserting just cause in termination letter
- relying on definition of just cause in employment contract |
