A recent decision in Alberta has made it a little clearer for employers as to what may constitute discrimination on the basis of family status. Although case law is still evolving employers can learn from this case by applying the following:

  • carefully consider requests for accommodation for employees with family obligations;
  • consider each request on a case-by-case basis;
  • identify potential accommodations such as flexible work arrangements, change in shifts or schedules that may provide a win-win solution;
  • remember that employers are obligated to accommodate to the point of undue hardship; undue hardship is a high threshold for courts.
