Medical Notes and Employee Absences

This article outlines a recent decision from the Ontario Superior Court of Justice confirming that employers are within their rights to ask for medical notes to verify an employee's absence from work due to illness. However, employers may not be able to terminate an employee who fails to comply with the request.

With 2016 behind us (did anyone really enjoy 2016?) we've hit the ground running into 2017. Compliance continues to be a popular topic amongst our clients however this year we have noticed a new trend around communication skills. This trend is across industries and sizes of clients. It seems both managers and employees are having a difficult time communicating effectively and respectfully. Maybe it's because of today's soundbite social media culture where info has to be relayed in 140 characters or less. Whatever the root cause, we are working on training with our clients to help them be more successful in this important area.

Proposed changes to Ontario's current Personal Emergency Leave are open to employer feedback and comments until Aug 31, 2016. The main proposals are as follows:

  • Maintain the status quo
  • Eliminate the 50 employee threshold
  • Break down the 10 day entitlement into separate leave entitlements for different categories that still add to total of 10 days
  • A combination of options 2 and 3 but maintaining different levels for different employer sizes.

Ontario's Mandatory Pension Plan is Coming - Are You Ready?

The ORPP is mandatory for employers without a comparable workplace pension plan. Are you ready? The ORPP will be implemented in waves as follows:

  • Wave 1: Large employers (500 or more employees) without registered workplace pension plans. Contributions to start: January 1, 2017.
  • Wave 2: Medium employers (50- 499 employees) without registered workplace pension plans. Contributions to start: January 1, 2018.
  • Wave 3: Small employers (49 or fewer employees) without workplace pension plans. Contributions to start: January 1, 2019.
  • Wave 4: Employers with a workplace pension plan that is not modified or adjusted to meet the comparability test, as well as employees who are not members of their workplace’s comparable plan. Contributions to start: January 1, 2020.

Meeting Needs of Job Applicants and Employees with Disabilities

Under Ontario's Accessible Employment Law, businesses and non-profits with 50 or more employees must make their employment practices accessible to meet the needs of employees and job applicants with disabilities starting January 1, 2016.

It was the main reason why one of our managing directors left the military and 19 years later it's sad to see nothing has changed. Without a solid change management process, including ensuring leaders walk the talk, blowing up the culture of silence and condonation and a true zero-tolerance policy, developing a new harassment-free culture will be difficult. Ensure your company's culture does not get entrenched in this manner by having a policy in place, training everyone on that policy, allowing complaints to be brought forward and swiftly investigating and dealing with them.

Free resource on navigating WSIB for Ontario employers with less than 100 employees:  The Office of the Employer Adviser (OEA) is an independent agency of the Ministry of Labour(MOL) and has been helping Ontario employers manage their workplace safety and insurance costs since 1985. They provide expert advice to any size employer, and represent primarily employers who employ fewer than 100 employees. Their service is completely confidential and you will never be charged a fee, given the OEA is funded through the premiums or administrative fees you pay the Workplace Safety and Insurance Board (WSIB).

New and young workers in Ontario are three times more likely to be injured during their first month on the job than at any other time. Find out the results of last year's OHSA blitz.   • assess the workplace for a risk of violence and to have a workplace violence and harassment policy in place

Tips on Handling Sick Leave

One of the best pieces of advice we have heard to date on handling sick leave and disability issues was from a recent law seminar on the topic. Medical notes are not court orders and employers shouldn't accept them at face value. Employers are well within their rights to ask for more information and should never accept nonsensical medical notes. We've been receiving many requests for assistance with sick leave issues lately; here's a link to one of our archived blogs on how to handle.

As of May 20th all Ontario employers need to post the new Employment Standards poster in
their workplaces where it can be seen by employees. All existing employees are also to have a copy of this poster given to them
individually by June 19, 2015 either as a printed version or as an email attachment. New hires are to receive it within 30 days of hire.

A recent decision in Alberta has made it a little clearer for employers as to what may constitute discrimination on the basis of family status. Although case law is still evolving employers can learn from this case by applying the following:

  • carefully consider requests for accommodation for employees with family obligations;
  • consider each request on a case-by-case basis;
  • identify potential accommodations such as flexible work arrangements, change in shifts or schedules that may provide a win-win solution;
  • remember that employers are obligated to accommodate to the point of undue hardship; undue hardship is a high threshold for courts.

New Obligations for Ontario Employers in 2015

Bill 18, The Stronger Workplaces for a Stronger Economy Act, 2014 passed recently in the Ontario legislature. It outlines new obligations for employers. Two in particular include:

  • Employer mandatory self-auditing for compliance with Employment Standards Act becoming effective May 20, 2015
  • New ESA poster to be distributed to each employee effective May 20, 2015

3.7 per cent average increase to starting salaries in professional occupations in 2015 via Canadian HR Reporter

There are minimum wage increases that will took effect in four jurisdictions effective October 1, 2014

·   In Manitoba , the minimum wage will increase from the current rate of $10.45 per hour to $10.70 per hour.

·   In Newfoundland and Labrador , the minimum wage will increase from the current rate of $10.00 per hour to $10.25 per hour.

Another AODA deadline approaching - Jan 1, 2015

Ontario organizations with 50+ employees have until Jan 1, 2015 to train all their employees and volunteers on the IASR (Integrated Accessibility Standards Regulation) as it relates to their organization, as well as training on Ontario's Human Rights Code related to disabilities.  (Note that Ontario organizations with 1 - 49 employees have until Jan 1, 2016 to provide this training.)  For more information on what is required, please read on.

Bill 21, Family Leaves, Amends Ontario's Employment Standards Act effective Oct 29, 2014

Effective October 29, 2014, employees in Ontario will have access to three new leaves:

  • Family Caregiver Leave: up to eight weeks of unpaid, job-protected leave for employees to provide care or support to a family member with a serious medical condition.
  • Critically Ill Child Care Leave: up to 37 weeks of unpaid, job-protected leave to provide care to a critically ill child.
  • Crime Related Child Death or Disappearance Leave: up to 52 weeks of unpaid, job-protected leave for parents of a missing child and up to 104 weeks of unpaid, job-protected leave for parents of a child who has died as a result of a crime.

Employee's Ultimatum to Quit Treated as Resignation

In Kerr v. 2463103 Nova Scotia Ltd. the Nova Scotia Supreme Court found that the plaintiff, Kerr, did indeed resign when he offered his employer an ultimatum of either receiving a pay increase or he would leave for another job offer. The employer indicated that if his job performance improved he would receive a pay increase. The employer waited 3 weeks. During that time Mr. Kerr did not retract his ultimatum, nor did he make any changes to improve his performance. After 3 weeks, the employer accepted his resignation and Mr. Kerr brought forward a motion of wrongful dismissal.

"The application was dismissed. Kerr's threat to resign was made in clear and unambiguous terms. A reasonable person would have understood that Kerr was serious in his intention to resign and take up another job opportunity that would pay more if he was not given the demanded raise. From the Just Cause Terminations webinar put on by HRPA yesterday "Termination is the Capital Punishment of employment law"; the highest disciplinary measure available to employers and therefore there is a high burden of proof on the part of the employer to prove just cause. Common mistakes employers make in trying to assert just cause include:

- verbal warnings only

- poor progressive discipline (inconsistency, unreasonable expectations, unreasonable timelines, no warning of further discipline)

- lack of consistency with other workers

- tolerance/condonation of the behaviour

- jumping to cause

- not asserting just cause in termination letter

- relying on definition of just cause in employment contract

Ministry Providing Free Training for AODA Compliance

The Ontario government has made things a little easier for companies conducting business in Ontario to become compliant with the training requirements of its AODA legislation. Check out their website where you can download modules for free. They even have the ability to link up to company Learning Management Systems!


What Businesses Need to Know About Ontario's Minimum Wage Panel Report

"Among the Panel's key recommendations to the government are to:

  • tie increases in the minimum wage to the CPI, a measure of inflation;
  • revise the minimum wage on an annual basis; and
  • provide businesses with four months notice of impending changes to the minimum wage (businesses would be notified of changes by December 1, and changes would come into effect on April 1)."

Desjardins was fined $4K for discriminating against a candidate on the basis of creed in Widdis v. Desjardins Group . Widdis was asked in a phone screen interview if she could work Saturdays as the call centre contract position required working rotational Saturdays. She indicated that as she was a 7th Day Adventist she could not work Saturdays.

"An employer can ask in a job interview about availability to work because it can refuse to hire someone who can’t work certain days, if the requirement to work those days is bona fide and reasonable, and there’s no way to accommodate the person’s religion. The key issue is whether the employer exhausts all possibilities for accommodation before refusing the applicant based on the inability to work that day in question."

  • They must monitor consumption and best practices would dictate limiting consumption;
  • Anyone in a responsible position (supervisors and above) should not be consuming alcohol at the party;
  • A plan must be developed before the event about how employees and others will get home safely and such plan should include the provision of transportation (for example – taxis)."

We attended their celebratory open house last week and really enjoyed hearing truly inspirational stories of some long-service employees. CKC has one of the longest-tenured averages amongst their employee base that we've come across.

BC's new Bullying and Harassment legislation became effective on November 1, 2013.  See WorkSafeBC's newly created Bullying and Harassment website for tools, policies and guidelines as to how to comply with this new legislation.

According to Payscale's Canadian Compensation Trends and Pay Practices survey, 65% of Canadian companies expected their financial performance to improve in 2013.  The use of variable pay increases (a pay for performance method), increased by a whopping 300%, as companies come up with creative ways of keeping their wage growth in line while at the same time retaining and incenting their top performers.

From the same Payscale survey, the following jobs had the largest year over year increases in Canada over the past 2 years:

How Long is an Employer Required to Accommodate a Disability-related Absence?

Employers have a duty to accommodate disability-related absences to the point of undue hardship. There is no particular length of time allotted and each case is unique. "The test of undue hardship is the relevant standard for assessing return-to-work programs....The following are examples of when an employee's extended absence may be considered undue hardship for the employer:

  • The employer is unable to attract or retain a qualified person for the position because the position is temporary (due to the pending return of the absent employee).
  • The cost of paying an employee's benefits while he or she is absent may become too high, and/or group insurance costs increase due to the absence.
  • The employee's skills may become outdated and he or she may no longer be able to perform the essential duties of the job.
  • A new business focus or approach may result in the elimination of the employee's job, and therefore the employee's skills are no longer needed."

Federal Government Announces New Employee-Led Work Schedules for Federal Employees April 1, 2013.  In a surprise move, the federal government announced this morning that it will begin allowing its employees to maintain their own work schedules effective April 1, 2013.

Ontario Proposes New Leaves of Absence

On March 5, 2013, the Government of Ontario introduced Bill 21, which proposes amendments that would provide job protection for employees who take certain family-related leaves of absence. If passed, Bill 21 will create three new leaves of absence:

  • Family caregiver leave whereby an employee could take up to eight weeks' leave per year for each seriously ill family member.
  • Critically ill child care leave would allow an employee to take an unpaid leave of absence of up to 37 weeks.
  • Crime-related child death or disappearance leave would allow an employee to take a leave of absence of up to 52 weeks if his or her minor child has disappeared as the probable result of a crime, and up to 104 weeks if his or her minor child has died as the probable result of a crime.

New Ontario Safety Awareness Training Requirement as of January 1, 2014

The Ministry of Labour proposes to introduce new regulatory requirements that would require employers to ensure that all workers and supervisors complete mandatory occupational health and safety awareness training programs. It is anticipated that the proposed new regulation would be filed on or before July 1, 2013 and would come into force on January 1, 2014.

You will be able to demonstrate compliance by having your workers or supervisors complete awareness training program products and materials that are being developed by the Ministry of Labour, or by having your workers or supervisors complete existing or alternate programs that met the minimum regulatory requirements. For more information, visit the MOL's website.

Injunction for Breach of Non-Solicitation Agreement Upheld

We often receive questions from clients as to whether non-solicitation and non-compete agreements are worth the paper on which they are written. If they are reasonably written, yes they are. In the case of Smilecorp Inc. v. Pesin ,2013 CLLC ¶210-009, the Ontario Court of Appeal upheld an injunction against Pesin, a dentist terminated by Smilecorp, for breach of its non-solicitation agreement. The non-solicitation covenant was reasonable and did not prevent Pesin from advertising generally about his new practice nor did it limit his ability to relocate. It simply prevented Pesin from communicating with those patients he treated at Smilecorp.

  • Designated public sector organizations: January 1, 2016
  • Large organizations (those with 50 or more employees): January 1, 2017
  • Small organizations (where applicable): January 1, 2018

The goal of the new standards is to remove barriers in public spaces.

Manitoba Death and Disappearance of a Child Leave In Force January 1

Manitoba recently amended its Employment Standards Code effective Jan 1, 2013 to provide unpaid Leave Related to the Death or Disappearance of a Child for an employee whose child has died or disappeared due to a crime. The leave is available for employees for up to 52 weeks if they are a parent of a child who has disappeared as a result of a crime. If the child has died as a result of a crime, the employee is entitled to take a leave of up to 104 weeks.

Failure to Report Workplace Accident – Wilful Misconduct

An employee’s failure to report the incident, along with his lack of remorse over what had happened, amounted to wilful misconduct. The Ontario Labour Relations Board upheld the company’s decision to terminate the employee without notice or severance pay. Read here for more details.

Saskatchewan Introduces New Employment Legislation

On December 5, 2012, the Government of Saskatchewan introduced Bill 85, The Saskatchewan Employment Act . The Act consolidates labour legislation from twelve Acts into one updated and comprehensive Act. “The new Saskatchewan Employment Act clearly defines the rights and responsibilities of employees, employers and unions,” Labour Relations and Workplace Safety Minister Don Morgan said. “The new Act will improve Saskatchewan's labour legislation to better protect workers, promote growth and increase accountability.”

Recent Changes to Minimum Wage Rates

Alberta's minimum wage rate increased to $9.75/hour on September 1, 2012 and Manitoba's increased to $10.25/hour on October 1, 2012.

British Columbia’s New Family Day Statutory Holiday

Family Day will be added as an additional statutory holiday in British Columbia effective in February 2013. It will be held on the second Monday of February.

AODA Reporting Deadline December 31, 2012

Although the deadline for compliance with the Accessibility for Ontarians with Disabilities Act, 2005 Customer Service Standard was January 1, 2012, businesses with 20 or more employees have until December 31, 2012 to submit their progress report online to the government. If you have still not yet developed a policy or trained your employees on how to provide excellent customer service to your Ontario customers with disabilities, our blog post has a refresher on how to become compliant.

Our associate consultant, Josie Martiniello, recently spoke at OARTY's (Ontario Association of Residences Treating Youth) General Meeting on October 25, 2012 on Human Resources in the Age of Social Media. Her presentation was very well received. It was HR à la carte's second year of presenting at OARTY's general meeting. Last year's presentation was on Employee Engagement and its Impact on Retention.

We attended the HR Summit Impact99 “Igniting a Social Workplace” in Mississauga, Ontario on October 24, 2012. We met some amazing thought leaders in both business and HR and will share some of the highlights that we think will help your business in our December newsletter.
